Hernia Mesh Lawsuits: Q&A with Attorney Brett Vaughn

Thousands of individuals are suing hernia mesh manufacturers over defective products that cause serious injuries such as organ damage, adhesions, chronic pain, infection, sepsis, bowel obstruction, and even death. In 2024, Becton Dickinson offered to settle 38,000 cases involving its subsidiary C.R. Bard, with an estimated settlement value of $1.7 billion. The litigation includes over 26,000 lawsuits consolidated into two multidistrict litigations (MDLs) involving companies such as Covidien/Medtronic, Bard/Davol, Ethicon/Johnson & Johnson, Gore, Atrium, and LifeCell. Despite settlements, manufacturers continue to sell the same products. Injuries vary widely and can lead to significant physical, mental, and financial strain. Jury awards range from $250,000 to $4,800,000, and plaintiffs are advised to consult experienced attorneys and obtain medical records, including implant identification records, to strengthen claims.
