In times of growing political scrutiny, cross-border transactions have become more complex and risk-prone. FGS Global ran a survey with political decision makers across key markets revealing critical factors that shape the political acceptance and public sentiment surrounding transactions. Our analysis of these factors is designed to help structure and communicate cross-border and multi-jurisdictional transactions, taking political and media concerns into account throughout the transaction process. Four things we now know: • Over 80% of political leaders in the US, UK, EU, Germany, France, and Italy believe that foreign direct investment screening should be more stringent. • 70% of decision makers in Europe seek closer scrutiny on Chinese investments, reflecting geopolitical concerns. • Sectoral sensitivities differ: the US prioritizes technology transfer, Germany is focused on security of supply, while job retention is the key issue in the UK. • Industry focus areas also vary: the defense sector raises the most concerns in Europe, while information and communication technology (ICT), energy, and healthcare are under the spotlight in the US, and the UK. Successful dealmakers know how to tailor their approach across regions and regulatory regimes. And that’s a wrap! FGS Prospero celebrated #HispanicHeritageMonth with a celebratory happy hour and virtual panel on the Latino vote. On Tuesday, October 8, we hosted a rooftop happy hour at the FGS Washington, DC office to celebrate FGS Prospero’s first anniversary with the firm and commemorate Hispanic Heritage Month. There was a good mix of stakeholders present— clients, Latino thought leaders, and reporters— to celebrate with us alongside wonderful colleagues. A week later, on October 15, FGS Prospero convened a panel of experts on the Latino vote to discuss trends, the race for the White House and the ever-dynamic community’s top issues and preferences. The panel was moderated by the legendary Lori Montenegro, Telemundo’s Washington, DC Bureau chief and one of the most respected Hispanic journalists in the country. The panelists were: • Carlos Díaz-Rosillo, PhD, Professor at Harvard and former Deputy Assistant Secretary of Defense for Western Hemisphere Affairs and the Acting Principal Deputy Assistant Secretary of Defense for International Security Affairs during the Trump Administration • Clarissa Martínez de Castro, Vice President of the Latino Vote Initiative at UnidosUS • Stephen Nuño-Pérez, PhD, Senior Analyst at BSP Research and Professor and the Richard D. “Alternative Futures - don’t just predict, prepare.” Last week we launched FGS Global ’s ‘Alternative Futures’ roadshow across our European offices in Amsterdam, Brussels and Paris. We met with around 200 business leaders and policymakers to discuss our Alternative Futures framework which helps companies to prepare for geopolitical developments – such as the US elections - that will have a meaningful impact on their business. Sebastian F. A. Vos together with our U.S. colleagues Michael Feldman , Josh Tzuker and Capricia Penavic Marshall explored what a Trump or Harris presidency would mean for the transatlantic relationship. Focus of their discussion was the likely outcome of the election, its impact on EU-U.S. foreign & trade policy and the prospects for future regulatory cooperation. Here are our key insights from the discussions: ▪ The outcome of the US elections, and duration of the interregnum, are nearly impossible to predict given the closeness of the race, the flaws in the polling models and the inevitability that the outcome will be litigated. Companies can and should prepare for these outcomes, and we believe that the Alternative Futures framework is an ideal way to do that. ▪ On foreign policy, Trump 2.0 would likely be very transactional, try to force a swift end to the war in Ukraine and disengage from NATO. President Harris would take a more traditional, multilateral approach and continue to work with NATO to support Ukraine. ▪ In Antitrust and competition policy “personnel is policy” – the future of antitrust will be determined by who Harris or Trump keep or appoint. Here again, Trump would be more transactional looking for “deals” rather than pursuing specific competition policy doctrines. The 2024 election has proven to be one of the most unpredictable ever. Using the Alternative Futures framework, we encourage our clients to plan for a range of possible outcomes rather than trying to predict the future. Curious to learn more about Alternative Futures?
