The SEC is not accepting downplaying or misrepresenting the scope of cyber incidents. The U.S. Securities and Exchange Commission has charged Unisys, Avaya, Check Point, and Mimecast with significant penalties for materially misleading investors regarding cyberattacks. https://lnkd.in/g6J6iHpA Here are the key charges and penalties for the four companies as announced by the SEC: 1>Unisys Corp. Charges: Misleading disclosures about cybersecurity risks and intrusions, and violations of disclosure controls and procedures. Penalty: $4 million civil penalty. Details: Unisys misrepresented its cybersecurity risks as hypothetical despite knowing that two SolarWinds-related intrusions had occurred, involving exfiltration of gigabytes of data. Deficient disclosure controls contributed to the misleading disclosures. 2>Avaya Holdings Corp. Charges: Misleading cybersecurity disclosures. Penalty: $1 million civil penalty. Details: Avaya downplayed a 2020 intrusion, stating that only a “limited number of email messages” were accessed, while knowing that at least 145 files in its cloud file-sharing environment had also been compromised. 3>Check Point Software Technologies Ltd. Charges: Misleading cybersecurity disclosures. Penalty: $995,000 civil penalty. Details: Check Point knew about an intrusion in 2020 but described the incident and related risks in generic terms, minimizing its significance. 4>Mimecast Limited Charges: Misleading cybersecurity disclosures. Penalty: $990,000 civil penalty. Details: Mimecast minimized the impact of a 2021 breach by not disclosing the nature of the exfiltrated code or the volume of encrypted credentials accessed by the threat actor.
