Freezing orders may be obtained over a defendant, or prospective defendant’s, assets, provided the plaintiff has a good, arguable case in their cause of action and there is a danger the judgment debt or prospective judgment debt will go unsatisfied due to the defendant absconding the jurisdiction or dissipating assets. 
 
Providing a critical tool to any plaintiff who has been the victim of fraud, courts will consider fraudulent conduct as good evidence of a future intention to dissipate assets and attempt to evade judgment, therefore satisfying one of the requirements for the grant of a freezing order. 
 
This principle has recently been applied in the NSW Supreme Court case Guildford Montessori Kindergarten Pty Ltd v Wehbe [2022] NSWSC 1560.
