🔋En partenariat avec BDO Suisse nous avons donné, le 12 novembre, notre première formation continue reconnue SAQ. Les prochaines dates sont le 19 novembre 2024 pour les EAM et au printemps 2025 pour un nouveau cycle Trustees et EAM. Compte tenu du succès rencontré lors de ce premier événement, nous nous réjouissons d'ancrer ces formations dans le paysage de la compliance et de la gestion du risque en Suisse romande. Les travaux sur le CARF se poursuivent à l’OCDE, avec des discussions sur les obligations de reporting des différentes couches (layers) de la finance décentralisée (DeFi): Settlement, Application and Interface layers. Cela relève la complexité à identifier les entités qui seront responsables d’appliquer le CARF. Idem pour déterminer les juridictions de résidence de Reporting CASP décentralisés. 2026 est proche, mais la route vers la mise en œuvre du CARF est encore longue et parsemée d’interrogations. Un grand aux équipes du Business at OECD (BIAC) et de OECD-OCDE pour leur accueil et les échanges.

🔔 Switzerland: FINMA Sanctions Mirabaud & Cie SA Over Serious AML Failures 🔔 The Swiss Financial Market Supervisory Authority (FINMA) recently concluded a high-profile enforcement case involving Mirabaud & Cie SA, marking a serious breach of Swiss financial market law. The Geneva-based private bank was found to have inadequately assessed and documented the economic background of multiple high-risk client relationships, which were connected to a now-deceased businessman accused of tax evasion. Key findings from FINMA’s investigation, initiated in 2021, include: 📌 Inadequate Risk Management: Mirabaud failed to meet regulatory standards regarding anti-money laundering (AML) procedures, including a lack of sufficient checks on beneficial ownership and transaction background across business relationships involving up to USD 1.7 billion in assets. 📌 Violations of Governance and AML Rules: The bank seriously violated its obligations concerning governance, risk management, and AML prevention. This situation persisted even after concrete warnings dating back to 2018. 📌 Regulatory Consequences: FINMA confiscated CHF 12.7 million in unlawfully generated profits. Additionally, Mirabaud is prohibited from onboarding any new clients presenting increased money-laundering risks until compliance measures are fully implemented. Three enforcement proceedings against individuals have also been initiated. While Mirabaud has implemented a broad range of operational and organisational reforms, including strengthening its governance and control systems, the case serves as a stark reminder of the importance of robust AML controls and effective risk management in financial institutions. For those of us navigating the complexities of financial regulation, this case underscores FINMA’s increasingly stringent stance on compliance failings, especially where governance and risk management intersect with AML obligations. It also shows that already based on today's existing laws, FINMA has a big variety of enforcement instruments and measures at hand enabling them to intervene in a flexible, but strict and targeted way. #FinancialRegulation #AML #Governance #RiskManagement #SwissBanking MLL Legal
