Earlier this year, the band formerly known as Easy Life, changed their name to Hard Life following a legal dispute with easyGroup over trade mark infringement. With over 200 registered marks in the UK, and the growing number of cases surrounding infringement of trade marks, the group continues to demonstrate its litigious approach when it comes to protecting its brand. In the recent case of Bernadette Lucretia Atkinson v (1) Central England Co-operative Ltd (2) Nikole Atkinson [2024] EWHC 2394 (Ch), the High Court dealt with a request to prevent a cremation based on religious preferences. The deceased’s daughter, Bernadette, argued for a burial according to Rastafarian customs, whilst Nikole (the deceased’s other daughter and Executor) aimed to follow the Will’s cremation instructions. The Court confirmed the legal position on ownership of a body and upheld the Executor’s authority, noting the deceased’s clear wishes in the Will. The recent case of Watts v Davies [2024] EWHC 1177 Ch highlights the importance of contemporaneous evidence in proving testamentary capacity. Philip Price, who was elderly and frail at the time of drafting his will, left his £800,000 estate to a close friend, while appointing a cousin as the Executor. However, following his passing, Barbara Watts (his half-sister), challenged the Will on grounds of lack of testamentary capacity.
