In the rapidly evolving world of cryptocurrency, staying ahead of compliance trends is crucial for industry executives. Here are five projections for 2024:

1. The Unforeseen Compliance Burden Post-MiCA: Beyond AML and TFR
As 2024 progresses, the crypto industry’s compliance professionals face a heavier workload than expected due to a MiCA license’s extended compliance demands. In addition to Anti-Money Laundering (AML) and Travel Rule (TFR) requirements, they now confront obligations under the Digital Operational Resilience Act (DORA), and Tax Transparency Rules for Crypto-Asset Transactions (DAC8). This broadened compliance scope, far exceeding MiCA’s initial compliance framework, challenges firms to adopt a comprehensive approach for regulatory adherence and operational restructuring

2. Increased Financial Industry Interest: Following the MiCA implementation, we anticipate a rise in the financial industry’s engagement with crypto-assets. The newfound regulatory clarity will enable banks to advise on and offer crypto investments. While a full-scale shift may not occur in 2024, expect to see a number of leading banks beginning to engage more openly with the crypto sector.

3. Continued Crypto Business Shift from the US to EU: Due to ongoing regulatory uncertainties in the US, we’re likely to see an increased shift of US crypto companies and investments towards the EU, where the implementation of MiCA provides the regulatory certainty that is lacking in the US.

4. Regulatory Clarity Leads to Increased Demand for Compliance Expertise: As regulations become clearer, the demand for compliance expertise in the crypto sector will rise. This might sound counterintuitive, but with clarity comes a large amount of text that needs to be understood. Few people will have the capacity and skills to become experts, but all crypto companies needs to comply.

5. Compliance Becomes a Competitive Edge: In 2024, compliance in the cryptocurrency industry is no longer just a regulatory requirement; it’s a strategic advantage. As the crypto market matures, companies that prioritise robust compliance frameworks are distinguishing themselves. This shift is driven by growing investor and consumer demand for transparent, secure, and legally compliant crypto services.

On November 7th, a pivotal moment unfolded for Payment Institutions like ours — the Council and the European Parliament reached a provisional agreement on instant payments. As a Payment Institution, we’re thrilled about the provisional agreement reached by the Council and the European Parliament on instant payments. This is a game-changer for real-time transactions in the EU and EEA, enhancing the strategic autonomy of our financial sector and offering immense benefits for both consumers and businesses.

The timeline ahead is clear: The deal is expected to pass through the EU Parliament’s committee and plenary, as well as the Council, within the next six months — a formality, but a crucial one. Following the regulation’s entry into force, there will be a transitional period of 12 months for member countries to implement this access.

Now, the anticipation builds as we await the details on the requirements and pricing for joining this infrastructure. We’re hopeful for fair and accessible conditions that will allow us to leverage this opportunity to its fullest potential.
