Firms should be addressing cyber risk even as they wait for the pending adoption of the SEC’s cyber risk management rules. That was a key takeaway coming out of the opening panel from last week’s National Compliance Outreach Seminar for Investment Companies and Investment Advisers. In addition, the panel offered the following recommendations: *As new technology is rolled out at your firm, you should be mapping that technology to applicable regulatory requirements and ensure that various stakeholders in compliance, IT, and operations are all involved in drafting policies tailored to your firm’s use of that technology. In particular, the panel noted that firms’ compliance manuals and BCP’s should be read carefully to ensure they don’t say conflicting things. * Mock exams, tabletop testing, and other simulations are great ways to test the implementation of controls at your firm. * Cyber training is critical, both for new employees who are more susceptible to phishing and ongoing training for all staff to cover emerging threats and techniques. * Vendor due diligence is growing in importance. Compliance with amendments to Reg. S-P will be required next year, and vendor oversight requirements increase for many firms. Pay close attention to contract terms around breach notification because advisers bear responsibility for the PII they collect from clients. * Cybersecurity risk assessments are key to identifying risks and establishing strong controls. Use external parties to help benchmark your firm. * Off-channel communications continue to pose a challenge to many firms. These are violations of SEC rules and aren’t just technical violations without ramifications. Salus GRC is uniquely positioned to help you manage these risks.
