🏛️ Gestern fand die öffentliche Expertenanhörung zum Cannabisgesetz (CanG) im Gesundheitsausschuss des Deutschen Bundestages statt. Die Komplexität der Debatte wurde durch die große Bandbreite der eingeladenen Expert:innen abgebildet. Diese kamen aus Bereichen wie der Sucht- und Drogenforschung, Polizei, Justiz, Ärzteschaft, Patientenvertretung, Sozialarbeit, Völkerrecht und Industrie.

Was wurde deutlich?
👉 An vielen Stellen wirft der vorliegende Entwurf des CanG noch Fragen bei den Expert:innen auf, vor allem was die Durchsetzbarkeit von Abstandsregeln, die Regelung von Nutzhanf und die fehlenden Konzepte und Finanzierung von Präventionsmaßnahmen betrifft.
👉 Die Expert:innen sind sich einig, dass für eine Versorgungsverbesserung von Patient:innen mit Medizinalcannabis der Genehmigungsvorbehalt abgeschafft werden muss.
👉 Um den Schwarzmarkt nachhaltig zurückzudrängen, braucht es neben Cannabis Clubs und Eigenanbau auch die angekündigte Säule 2 mit wissenschaftlich-begleiteten Pilotprojekten. 

👣 Wie geht es jetzt weiter? Die Expertenanhörung dient den Mitgliedern des Gesundheitsausschusses als Grundlage für ihre weitere Beratung am Gesetzestext. Am Ende der Beratungen steht eine Beschlussempfehlung, die Änderungsvorschläge am Gesetz enthält und dann zur 2./3. Lesung in den Bundestag übergeht, wo über den Entwurf abgestimmt wird.

🏛️ Yesterday, the public expert hearing on the Cannabis Act (CanG) took place in the Health Committee of the German Bundestag. The complexity of the debate was reflected by the wide range of experts invited. They came from areas such as addiction and drug research, the police, the judiciary, the medical profession, patient representatives, social work, international law and industry.

What became clear?
👉 In many areas, the current draft of the CanG still raises questions among the experts, especially with regard to the enforceability of distance rules, the regulation of industrial hemp and the lack of concepts and funding for prevention measures.
👉 The experts agree that the approval requirement for reimbursement must be abolished in order to improve the care of medical cannabis patients. 
👉 In addition to cannabis clubs and home cultivation, the announced pillar 2 with evidence-based pilot projects is also needed to push back the black market in the long term. 

👣 What happens now? The expert hearing serves the members of the Health Committee as a basis for their further deliberations on the draft law. At the end of the deliberations, there is a recommendation for a resolution that contains proposed amendments to the law and then passes to the 2nd/3rd reading in the Bundestag, where the draft is voted on.

3 Jahre Vorbereitungszeit sind in unser wissenschaftliches Modellprojekt in der Schweiz geflossen und wir sind mehr als stolz, es nun endlich offen publizieren zu dürfen. In unseren Abgabestellen in Allschwil und Liestal (Basel-Landschaft) werden wir als Sanity Group in den nächsten Jahren gemeinsam mit Michael Schaub vom ISGF wissenschaftliche Daten als Entscheidungsgrundlage für eine mögliche Legalisierung in der Schweiz erheben - unser Fokus liegt dabei auf 'Harm Reduction' und ist mit knapp 4.000 möglichen Teilnehmern das derzeit größte, freigegebene Modellprojekt in der Schweiz.

Sanity Group is proud to announce a significant milestone: Alongside our esteemed partner, the Swiss Institute for Addiction and Health Research (ISGF), we have received final approval to conduct a pioneering study on the controlled dispensing of recreational cannabis in the canton of Basel-Landschaft, Switzerland.🇨🇭

The aim is to learn more about the effects of controlled access to cannabis and thus provide a solid scientific basis for possible decisions on future cannabis regulation in Switzerland. The study, led by Prof. Dr. Michael Schaub, Scientific Director of the ISGF, will examine the regulated sale of cannabis for non-medical purposes.

In the upcoming weeks, we will open Europe's first legal cannabis dispensaries in Basel-Landschaft!

🥦 Grünes Licht die Sanity Group im Zuge der schweizerischen Modellprojekte. 

✔ Die Sanity Group und das Schweizer Institut für Sucht- und Gesundheitsforschung (ISGF) haben vom Schweizer Bundesamt für Gesundheit (BAG) die finale Freigabe zur Durchführung eines Modellprojekts zur kontrollierten Abgabe von Cannabis zu Genusszwecken im nordwestschweizerischen Kanton Basel-Landschaft (Baselland) erhalten. Das vermeldet die Sanity Group in einer Pressemitteilung. 

💡 Ziel der wissenschaftlich begleiteten Untersuchung ist, mehr über die Auswirkungen eines kontrollierten Zugangs zu Cannabis zu erfahren und damit eine solide wissenschaftliche Grundlage für mögliche Entscheidungen über eine künftige Cannabis-Regulierung in der Schweiz zu schaffen. Die Studie unter dem Namen Grashaus Projects soll noch in diesem Jahr starten. 

⚡ Die Abgabe erfolgt zunächst über eine erste Verkaufsstelle in der Gemeinde Allschwil, ein weiterer Standort in Liestal soll in Kürze folgen. Damit entstehen im Kanton Basel-Landschaft die ersten legalen Cannabis-Shops in Europa. Die Sanity Group ist das einzige deutsche Unternehmen, das zur Teilnahme an den Schweizer Pilotprojekten berechtigt ist.

Die deutsche Bundesregierung schaut nun ganz genau auf die Studienergebnisse der Schweiz, um sich hier Ideen für die deutschen Modellversuche in der sogenannten Säule 2 der #Cannabis-#Legalisierung abzuschauen.

🏛 Gestern fand im Bundestag die erste Lesung zum geplanten #Cannabisgesetz (Säule 1) statt. Bei den Stellungnahmen der Fraktionen gab es keine großen Überraschungen – während die Sprecher:innen der Ampelfraktionen den Gesetzentwurf als Paradigmenwechsel lobten, kritisierten die Sprecher:innen der Opposition den Entwurf als gefährlich für Jugend- & Gesundheitsschutz. 

Daneben wurden Verbesserungsvorschläge am Gesetzentwurf gefordert, u. a.:
- Mindestabstände für Anbauvereinigungen & Konsumabstände zu Kinder- & Jugendeinrichtungen sollten verändert/aufgehoben werden (SPD, Grüne, FDP, Linke)
- Konsumverbot in Clubs sollte aufgehoben werden (SPD, Grüne, FDP, Linke)
- Konsumverbot für Patient:innen sollte aufgehoben werden (FDP)
- Grenzwerte im Straßenverkehr sollten angepasst werden (SPD, Grüne, Linke)
- Obergrenzen für THC & Besitzmengenbegrenzung sollten aufgehoben werden (FDP)
- Stärkung der Therapiehoheit der Ärzteschaft (CDU/CSU)
- Anpassung des Genehmigungsvorbehalts (CDU/CSU)

👉 Im nächsten Schritt wird der Gesetzentwurf zur genaueren Prüfung und Bearbeitung an den zuständigen Ausschuss weitergeleitet. Dort findet i. d. R. auch eine Anhörung von Expert:innen statt. Für das CanG wird diese am 6.11.2023 im Gesundheitsausschuss stattfinden. Am Ende der Beratung in den Ausschüssen gibt es eine Beschlussempfehlung, die Änderungsvorschläge am Gesetz enthält. Die Beschlussempfehlung geht dann zur zweiten/dritten Lesung in den Bundestag, wo über den Entwurf abgestimmt wird.

🇬🇧 Yesterday, the Cannabis Law (CanG) was introduced in the German Bundestag. This so-called 1st reading as part of the parliamentary process includes a debate in which the spokespersons inside of the various parliamentary groups express their viewpoints on the necessity and goals of the proposed law. There were no major surprises in the statements of the parliamentary groups, but some meaningful improvement ideas to the bill:
- Minimum distances for cannabis clubs & consumption distances to children’s and youth facilities should be changed/removed (SPD, Greens, FDP, The Left).
- Ban on consumption in clubs should be lifted (SPD, Greens, FDP, The Left)
- Consumption ban for patients should be lifted (FDP)
- THC limits in road traffic should be adjusted (SPD, Greens, The Left)
- Upper limits for THC & Cannabis possession limits should be lifted (FDP)
- Strengthening of the medical profession’s therapeutic sovereignty (CDU/CSU)
- Adjustment of the authorisation requirement of the health insurance companies (CDU/CSU)

In the next step, the draft law will be forwarded to the Bundestag health committee for a more detailed examination and processing. A hearing of experts will be held there on November 6th, 2023. At the end of the deliberations in the committees, there will be a recommendation containing proposed amendments to the law. The recommended resolution then goes back to the Bundestag for a 2nd/3rd reading, where the draft is voted on (currently scheduled for Nov 16th).
