The new Product Liability Directive is published: https://lnkd.in/e8K5Ns3J It has 5 main novelties - 1) Digital - It extends the definition of “product” to digital manufacturing files and software. Also online platforms can be held liable for a defective product sold on their platform just like any other economic operators if they act like one. 2) Circular economy: When a product is repaired and upgraded outside the original manufacturer’s control, the company or person that modified the product should be held liable. 3) Disclosure of evidence: The right to compensation has been made easier by ensuring that an injured person who claims compensation before a national court can request access to relevant evidence at the disposal of the manufacturer in order to be able to prove their claim. 4) Products bought from non-EU manufacturers: Under the new rules, to make sure that consumers are compensated for damages caused by a product manufactured outside of the EU, the company importing the product or the EU-based representative of the foreign manufacturer can be held liable for damages. 5) Burden of proof: When the injured consumer is faced with excessive difficulties to prove the defectiveness of the product or the causal link between its defectiveness and the damage, a court may decide that the claimant is only required to prove the likelihood that the product was defective or that its defectiveness is a likely cause of the damage. The Directive will have to by transposed in national law by 9 December 2026.

Last Tuesday, the confirmation hearings in front of the European Parliament (almost) came to an end. A few more steps to go for some Commissioners, and a final key vote most likely at the end of November still stand in the way of the new College of Commissioners. The #LevelPlayingField was a hot topic, with numerous Commissioners-designate insisting on its importance regarding: 📌 product safety & compliance 📌 consumer protection 📌 customs & market surveillance Boosting the digital and green transition was also key to #ecommerce discussions, with Commissioners-designate pushing for: 📌 a #DigitalFairnessAct 📌Implementation & enforcement of existing rules such as #DSA , #DMA & #GDPR , and upcoming ones like #GPSR & #ESPR 📌And a #CircularEconomyAct with a Single Market for waste Finally, a big focus was given to the need to reduce administrative, regulatory, and reporting burdens, especially for #SMEs . Today, Ecommerce Europe , EuroCommerce and Independent Retail Europe presented the results of a study about “Digital Fairness in Online Retail”. This study by Prof. Dr. Jürgen Kühling and Mr. Cornelius A. Sauerborn concludes that the current legal framework is mostly fit to ensure digital fairness and there is no need for a major overhaul of existing rules to address concerns against the backdrop of “dark patterns”. 🇪🇺 Commissioners hearing: first week is completed! Last Monday, the confirmation hearings in front of the European Parliament kicked off, with 20 Commissioners-designate being interviewed by the MEPs during the whole week. 📣 European Commission and national authorities urge #Temu to respect EU consumer protection laws 📣 Today, following a coordinated investigation at EU level, the CPC Network of national consumer authorities and the Commission notified Temu of a number of practices on its platform that infringe EU consumer law. The CPC Network directed Temu to bring those practices in line with EU consumer rules. Temu remains under investigation and was requested to provide further information to the network. The CPC action is led by the authorities of Belgium, Germany and Ireland, under the coordination of the Commission. The CPC Network is also investigating whether Temu complies with specific information obligations for marketplaces under consumer law. The recent DSA proceedings and the CPC Network's joint enforcement action are complementary to each other, aimed at ensuring a safe and trustworthy online environment where the rights of consumers in Europe are fully protected. ❗ The scrutiny of the CPC Network is in line with Ecommerce Europe's call for a level playing field and effective enforcement of EU law towards all #ecommerce players, no matter where they are based. Read more about our campaign here ⬇️ https://lnkd.in/dha8dDyu Problematic practices identified by the CPC on Temu are: ➡️ Fake discounts: Giving the false impression that products are offered with a discount where there is none. ➡️ Pressure selling: Putting consumers under pressure to complete purchases using tactics like false claims about limited supplies or false purchase deadlines. ➡️ Forced gamification: Forcing consumers to play a ‘spin the fortune wheel' game to access the online marketplace, while hiding essential information about the conditions of use linked to the rewards of the game. ➡️ Missing and misleading information: Displaying incomplete and incorrect information about consumers' legal rights to return goods and receive refunds. Temu also fails to inform consumers in advance that their order needs to reach a certain minimum value before they can complete their purchase. ➡️ Fake reviews: Giving inadequate information about how Temu ensures the authenticity of reviews published on its website. National authorities found reviews which they suspect to be unauthentic. ➡️ Hidden contact details: Consumers cannot easily contact Temu for questions or complaints. Next steps: Temu has one month to reply to the CPC Network's findings and propose commitments on how to address the identified issues. Depending on Temu's reply, the CPC Network may enter a dialogue with the company. On my way back to Brussels with my colleague Juliette Beaulaton after the strategic meeting of the Executive Committee of Ecommerce Europe , preparing for our upcoming General Assembly and Board of Directors meetings in December. This was a particularly important two-day meeting, as we had a preliminary discussion on the updated Strategic Action Plan of Ecommerce Europe, covering the period 2025-2027, a key topic on the agenda for next month’s Board of Directors meeting. The future of the digital commerce sector in Europe and the association itself were central to our discussions. We addressed challenges, such as ensuring a Level Playing Field with non-EU-based players, as well as opportunities arising from the 2024 elections and the start of the new EU mandate. I would like to thank all ExCom members for their valuable insights and support, with special thanks to Thuiswinkel.org 's Marlene ten Ham and Maike Jansen for the warm welcome and hosting us in Amsterdam.
