Tom Witherspoon authored an article for Law360 exploring the Consumer Financial Protection Bureau 's efforts to combat "junk fees" in school lunch payment processing, particularly as schools transition to cashless systems and partner with online payment platforms that charge for the service. Tom says school lunches are another entry point into a conversation about the CFPB's consumer protection authority with respect to payment processing. He notes that the CFPB's scrutiny is not limited to school lunch payment processing, emphasizing its broad application to the regulation of digital wallets and payment apps, which he says gives the CFPB another tool to inspect such fees across other markets. Jeetander Dulani , William Kearney Jr. and J. Nicci Warr examined the exclusion of proposed labor market provisions in the FTC's recently-announced final rule on premerger notification filings. In a Law360 article, they note that the lack of labor market considerations in the new Hart-Scott-Rodino rules is seen by some as a shift in focus by the FTC, indicating the agency will lessen its focus on labor markets. However, they say the merger guidelines approved in December 2023 suggest labor market issues will remain a priority. The attorneys say the antitrust agencies are likely to continue to refine the way they analyze labor markets, seeking more specific — and relevant — information during an investigation, rather than relying on broad categories of information in premerger filings. Ed and Rob are presenting a seminar, "Giving Survivors Voice and Power in Bankruptcy," focusing on advocating for survivors in ways that ensure their rights are protected, their injuries are redressed and their voices are conveyed with authority, potency and maximum impact. They'll also focus on survivor participation in the bankruptcy process, emphasizing its importance for fairness and legitimacy of the case and for a comprehensive understanding of the extent of the abuse and its lasting impact. Ed is also co-presenting a seminar, "Holding Wrongdoers Accountable in Bankruptcy" with James Stang and Brent Weisenberg, examining the Bankruptcy Code and how its flaws fail survivors, and providing guidance for improving the bankruptcy system.
