As a general rule, the Insolvency and Bankruptcy Code prohibits the termination of contracts for the supply of critical goods or services unless there is a default on current dues. In a recent judgment, the Supreme Court held that arbitrators cannot unilaterally revise their fees. However, the Court clarified that an attempt to do so would not necessarily constitute grounds for termination of the arbitrators’ appointment.
