LinkedIn, the Microsoft-owned professional social network, has been fined €310 million (approximately $335 million) by Ireland's Data Protection Commission (DPC) for violating the European Union's General Data Protection Regulation #GDPR . The fine was issued on October 24, 2024, following an investigation that began with a complaint in 2018. Key points of the decision: 1. LinkedIn failed to obtain valid user consent for processing personal data for behavioural analysis and targeted advertising. 2. The company improperly relied on "legitimate interests," "contractual necessity," and invalid consent as legal bases for processing user data. 3. LinkedIn did not adequately inform users about how their data was being used, violating GDPR principles of transparency and fairness. 4. The investigation found breaches of multiple GDPR articles, including Article 6 (lawfulness of processing) and Article 5(1)(a) (fairness and transparency). 5. In addition to the fine, LinkedIn has been given three months to bring its European operations into compliance with GDPR requirements. LinkedIn stated that while they believe they were in compliance with GDPR, they are working to ensure their ad practices meet the DPC's decision by the deadline. This fine places LinkedIn among the top 10 largest GDPR penalties imposed on tech companies to date. The case highlights the ongoing scrutiny of data processing practices by social media and professional networking platforms in the EU, particularly concerning targeted advertising and user profiling. https://lnkd.in/eHGU8K8U
