Advancing the Interests of the International Banking Community in the United States | The IIB&#39;s mission is to ensure that federal and state banking laws and regulations provide international banks operating in the United States with the same competitive opportunities as domestic banking organizations.  Applying U.S. banking laws and regulations to the U.S. branches, agencies, securities affiliates and other operations of international banks is enormously complicated and can produce unintended adverse results.  The IIB therefore carefully monitors legislative, regulatory and judicial developments at the federal and state level and advocates, as appropriate, to seek results that are consistent with the U.S. policy of national treatment and advancing the interests of its members.

Insightful new paper by the Bank Policy Institute on the regulatory challenges faced by the U.S. operations of international banks, particularly intermediate holding companies (IHCs). The IIB supports the paper's conclusion and recommendation for a "holistic review" of the current regulatory framework: "U.S. regulators should conduct a holistic review of how these regulations interact, considering the unique nature of IHCs. The current regulatory environment has impaired the mobility of bank capital across subsidiaries and reduced the diversification benefits of global banks. This review should include adjustments to the Fed’s stress testing models to better reflect the business models of IHCs and to modify the proposed standardized approach for operational risk under the Basel III Endgame proposal to account for the unique risk profile of IHCs."

The IIB is advocating for critical changes to a proposed rule implementing the Anti-Money Laundering Act of 2020. Capitol Account noted a major concern of the IIB in coverage yesterday about the Financial Crimes Enforcement Network, US Treasury 's AML program proposal: "Companies with overseas operations took issue with a provision that requires certain AML work to be 'performed by' employees based in the U.S. The Institute of International Bankers argued that the law only requires that the programs be overseen in the U.S., while Fincen is going much further. 'Onshoring to the United States of a significant portion of AML/CFT functions currently conducted offshore would require extraordinarily high expenditure for no meaningful benefit,' IIB wrote."
